Health+ AI (hereafter also referred to as "app" or "Service") is a freemium AI-powered health, nutrition and weight-management app for iOS. The app is offered by the service provider (hereafter also referred to as "we") with a free tier and optional auto-renewing premium subscriptions. By downloading, installing or using the app you agree to these Terms of Use. Please read them carefully before using the app.
These Terms form a binding agreement between you and Dr. Alper Beser, Dr.-Golm-Str. 24, 27232 Sulingen, Germany ("we", "us"). If you do not agree to these Terms, do not use the Service.
Health+ AI is not a medical device and is not intended to diagnose, cure, treat, monitor or prevent any disease, condition or symptom. The calorie and macronutrient estimates, AI-generated suggestions, chat replies and visualisations provided by the app (including by the AI assistant "AIRA") are for general informational and lifestyle purposes only and do not constitute medical, dietary, diagnostic or therapeutic advice. AI outputs may be inaccurate, incomplete or unsuitable for your individual situation.
Always consult a qualified physician, registered dietitian or other licensed healthcare professional before making decisions that affect your health, including changes to diet, fasting, exercise, medication or treatment, especially if you are pregnant or breastfeeding, have a medical condition (such as diabetes, cardiovascular disease, an eating disorder, kidney or liver disease), are recovering from an illness or surgery, or are taking any medication.
Do not rely on the app in an emergency. In case of a medical emergency, call your local emergency number.
To the extent permitted by applicable law, Dr. Alper Beser accepts no responsibility for any harm, loss, or adverse outcome resulting from your reliance on AI outputs of the Service or from using the Service in place of professional medical advice. This disclaimer does not exclude or limit liability that cannot be excluded or limited under mandatory law (in particular for injury to life, body or health caused by intent or negligence).
Health+ AI has not been reviewed, registered, certified, cleared or approved as a medical device, a wellness device or a medicinal product by any regulatory authority, including but not limited to the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), the German Federal Institute for Drugs and Medical Devices (BfArM), the UK Medicines and Healthcare products Regulatory Agency (MHRA), or any other competent authority. The app is offered as a general consumer wellness and lifestyle tool. It is not designed, intended or suitable for clinical use, for the diagnosis of any disease or condition, for the cure, mitigation, treatment or prevention of disease, or for any safety-critical purpose.
Using the Service does not create a physician–patient relationship, a dietitian–client relationship, a therapist–client relationship, or any other professional, fiduciary or care relationship between you and Dr. Alper Beser, our AI assistant "AIRA", any underlying AI model provider, or any other party. The Service is not a substitute for a consultation with a qualified, licensed healthcare professional who knows your individual medical history.
Health+ AI's meal analysis, calorie and macronutrient estimates and ingredient suggestions are AI-generated approximations. They cannot reliably identify the presence or absence of allergens (such as peanuts, tree nuts, gluten, dairy, eggs, shellfish, soy, sesame or other allergens), residues, additives, cross-contamination, hidden ingredients, restaurant preparation methods, or substances that may be contraindicated for your individual condition (such as carbohydrates for individuals with diabetes, phenylalanine for individuals with phenylketonuria, oxalates, FODMAPs, gluten, lactose, fructose, histamines, salicylates, or any other substance).
Do not rely on Health+ AI to avoid allergens or substances that are dangerous to you. If you have a food allergy, intolerance, sensitivity, eating disorder, metabolic disorder (such as diabetes, PKU, galactosemia or similar), are pregnant or breastfeeding, are an athlete with regulated nutritional requirements, or have any other special dietary condition, you must independently verify all foods and ingredients with the food's manufacturer, your healthcare professional, your dietitian or another reliable source before consumption. To the fullest extent permitted by applicable law, we accept no liability for allergic reactions, intolerance reactions, metabolic events, or other adverse health outcomes caused by reliance on Health+ AI's outputs.
Your responsibility for inputs. The accuracy of the personalised information, calorie targets, AI-chat replies and other outputs you receive depends on the accuracy of the data you provide (in particular your age, sex, height, current weight, target weight, activity level, goals, medical conditions and medications). You are responsible for entering and maintaining accurate, complete and up-to-date data. Errors, omissions or deliberate misstatements in your inputs may result in significantly inaccurate or harmful outputs.
HealthKit and device-sensor accuracy. Where the app reads health and fitness data from Apple HealthKit (e.g. step count, energy burned, heart rate, sleep, body weight, body-fat percentage), the accuracy of that data depends on third-party hardware and software (e.g. Apple Watch, third-party scales, third-party fitness apps) and on how you use them. Sensor data may be inaccurate, missing, delayed or anomalous. We do not warrant or verify the accuracy of HealthKit data and are not liable for outcomes based on inaccurate sensor data.
Voice transcription accuracy. Voice meal logging relies on Apple's Speech Recognition framework, which may misinterpret speech, transcribe inaudibly, or produce incorrect words. You are responsible for reviewing transcriptions before submitting them to AI analysis.
AI output accuracy. Calorie and macronutrient estimates produced by AI are approximations and can deviate substantially (in both directions) from the true values. AI chat responses may be factually incorrect, outdated, biased, internally inconsistent, or "hallucinated" (i.e. plausibly worded but false). AI-generated meal images are illustrative artwork only; they are not photographs and must not be used to identify specific foods, products, brands, ingredients, portion sizes or allergens.
Third-party AI providers. AI outputs are produced by third-party AI services (in particular Google's Vertex AI / Gemini, and Apple's Image Playground where applicable). We do not control the inner workings of these models and disclaim, to the fullest extent permitted by applicable law, any liability arising from the content of third-party AI outputs.
Individual results vary. Health+ AI does not guarantee any particular outcome — including but not limited to weight loss, weight gain, weight maintenance, body-composition changes, fitness improvements, biomarker changes, medical improvements, behaviour change, habit formation, or any other personal goal. Any progress depicted in in-app screenshots, marketing materials or testimonials reflects individual experiences and is not a promise that you will achieve similar results. Achieving your goals depends on many factors beyond our control, including genetics, lifestyle, medical history, environment, compliance with recommendations and luck.
You agree not to use Health+ AI, its outputs or its AI chat for any safety-critical decisions, including but not limited to: dosing of insulin or other medications; calculation of intravenous nutrition; clinical nutrition for inpatients or tube-fed individuals; pre-operative or post-operative care; emergency triage; piloting, professional driving or operating heavy machinery; substance-use decisions; or any other context where an incorrect output could cause injury, death or significant harm. The Service is not designed or fit for such uses.
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the app on devices you own or control, solely for your own personal, non-commercial use, in accordance with these Terms and the Apple App Store's standard End User License Agreement.
You may not clone, copy, modify, adapt, translate, redistribute, sell, sublicense, lease, decompile, disassemble or reverse-engineer the app or any of its parts; nor remove or obscure proprietary notices or trademarks; nor create derivative works based on the app or our content. The app and all related trademarks, copyrights, database rights and other intellectual property rights belong to Dr. Alper Beser or its licensors.
The name "Health+ AI", the AI assistant name "AIRA", the app icon and all graphical assets are protected.
The Service is not intended for children under 16 years of age. By using the Service, you represent and warrant that you are at least 16 years old, that you are legally capable of entering into a binding contract under the laws of your country of residence, and that you are not barred from using the Service under any applicable law. If you are between 16 and 18 years old (or under the age of majority in your country), you represent that you have obtained the consent of a parent or legal guardian to use the Service.
The Service is not intended for use by individuals with medical conditions for whom AI-generated nutrition guidance could be unsafe (in particular individuals with active eating disorders); we strongly recommend that such users seek professional care instead of relying on the app.
You are solely responsible for the content you submit to the app, including meal photos, voice recordings, text descriptions, chat messages and profile information ("User Content"). By using the AI features, you instruct us to transmit your User Content together with the context described in our Privacy Policy to Google's Firebase AI Logic / Vertex AI / Gemini service (and, for voice input, to Apple's Speech Recognition service) for processing in accordance with that Policy. Processing may occur on servers located in the United States and other countries.
You represent and warrant that your User Content does not infringe any third-party right, is not illegal, hateful, harassing, sexually explicit, defamatory or otherwise prohibited under our Privacy Policy or these Terms, and does not contain malware. Do not submit content of others without their consent. Avoid submitting sensitive personal data of third parties.
You retain ownership of your User Content. You grant us a worldwide, royalty-free, non-exclusive licence to host, store, transmit, display, reproduce and process your User Content solely to the extent necessary to operate the Service for you (e.g. to perform the AI calls you request and to show the results back to you). We do not use your User Content to train AI models. AI-generated outputs (such as meal images, calorie estimates and chat responses) are provided to you for your personal use and may not be sold or redistributed.
We may, without obligation, remove or disable access to any content that we reasonably believe violates these Terms or applicable law.
AI accuracy. The Service uses generative AI. AI outputs can be wrong, incomplete or inappropriate. Calorie and macronutrient estimates are approximations and can deviate substantially from real values. Do not rely on AI outputs for medical, legal, financial, safety-critical or other consequential decisions.
With your permission the app may read fitness and health data from, and write nutrition and weight data to, Apple HealthKit. We use HealthKit only to provide and personalise the Service for you, including by including a snapshot of recent fitness data in AI prompts as described in our Privacy Policy. We do not sell HealthKit data, do not use HealthKit data for advertising, and do not share HealthKit data with third parties other than Google for the purposes described in the Privacy Policy. You can revoke HealthKit access at any time in iOS Settings.
The app uses third-party services that have their own terms. Links to the terms of the third-party providers we use:
Certain functions of the app (in particular meal analysis, AI chat, image generation and voice transcription) require an active internet connection. We are not responsible if the app does not work at full functionality due to a lack of Wi-Fi or mobile data. If you use the app outside a Wi-Fi area, the terms of your agreement with your mobile network provider continue to apply; data and roaming charges may apply.
The app relies on Apple's Speech Recognition service for voice transcription. Apple imposes technical limits on that service (currently, an iOS device may make up to approximately 1,000 speech-recognition requests per hour). We have no control over this limit and Apple may change it at any time.
To protect the Service from abuse and ensure stability for all users, we apply rate limits and quotas to AI features and may temporarily restrict features if usage exceeds normal patterns. We reserve the right to adjust these limits at our discretion.
Dr. Alper Beser cannot accept responsibility for issues caused by jailbreaking or rooting your device, by your device running out of battery, or by your failure to install required updates.
Health+ AI offers premium features through auto-renewing subscriptions sold via in-app purchase. The subscription options, prices, currencies and free-trial conditions available to you are displayed inside the app at the time of purchase and may vary by region.
Refunds for in-app purchases are processed by Apple. We do not handle refund payments directly. Please request refunds via Apple at reportaproblem.apple.com or via your Apple ID account settings.
EU consumers — right of withdrawal. If you are a consumer resident in the European Union, you generally have a 14-day right of withdrawal for purchases of digital content (§ 312g BGB / Art. 9, 16 of EU Directive 2011/83/EU). By starting to use a paid feature (e.g. by performing your first premium AI call after a purchase) and confirming that you wish to do so before the end of the withdrawal period, you expressly request immediate performance and acknowledge that your right of withdrawal lapses upon full performance of the contract. Where the right of withdrawal still applies, you may exercise it by contacting Apple as described above (Apple is the merchant of record) or by contacting us at HealthPlusAI.app<at>gmail.com.
By using the app and making in-app purchases, you consent to our sharing aggregated, pseudonymous consumption data (such as account age, total play time, total purchases, total refunds, account status and platform) with Apple when Apple processes a refund request, as further described in our Privacy Policy.
You agree not to misuse the Service, including by:
We may suspend or terminate your access to the Service for any violation of these Terms.
The app is currently available on iOS. We may release updates from time to time; system requirements may change, and you may need to install updates to keep using the app. We do not promise that we will always update the app to remain relevant to you or to work with every iOS version that you have installed.
We may also discontinue the Service or any feature at any time. Subject to applicable consumer-protection law, we may suspend or terminate your access to the Service at any time, with or without cause, and with reasonable notice where required by law. Upon termination (a) the rights and licences granted to you in these Terms will end and (b) you must stop using the app and (if needed) delete it from your device. Sections that by their nature should survive termination (e.g. disclaimers, limitations of liability, indemnification, governing law) will survive.
Subscriptions and in-app purchases are only available as long as the app remains available on the App Store. If the app is removed from the App Store or its distribution is discontinued, access to those services and subscriptions will also end. Refunds for the remaining period of a discontinued subscription may be sought from Apple in accordance with Apple's policies.
To the maximum extent permitted by applicable law, the Service and all materials, information, products and services included in or available through the Service are provided "as is" and "as available" for your use, without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability or freedom from error. We do not warrant that the Service will be uninterrupted, secure or error-free, that defects will be corrected, or that the Service or its servers are free of viruses or other harmful components. We do not warrant the accuracy, completeness or suitability of AI outputs.
To the fullest extent permitted by applicable law, in no event shall Dr. Alper Beser, its affiliates, or their respective directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Service, including but not limited to loss of profits, data, use, goodwill or other intangible losses, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total aggregate liability to you for all damages, losses and causes of action (whether in contract, tort, including negligence, or otherwise) arising out of or related to the Service shall not exceed the greater of (a) the amount paid by you, if any, for accessing the Service during the twelve (12) months immediately preceding the date of the claim, or (b) fifty euros (EUR 50).
Statutory rights. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory law, in particular: liability for injury to life, body or health caused by intent or negligence; liability for other damage caused by intent or gross negligence; liability under the German Product Liability Act (Produkthaftungsgesetz); and statutory consumer rights (including, where applicable, your statutory warranty rights and the EU consumer right of withdrawal). Where we have assumed a guarantee or where liability is mandatory under the Product Liability Act, our liability is governed by statute.
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Dr. Alper Beser, its affiliates and their respective directors, officers, employees, agents and licensors from and against all claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your use of the Service in breach of these Terms; (ii) your User Content; (iii) your violation of any rights of another party; or (iv) your violation of any applicable law. This indemnity does not apply to claims arising from our gross negligence or wilful misconduct, or where indemnity is prohibited by mandatory law.
Your privacy is important to us. Our processing of personal data is described in our Privacy Policy, which forms part of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer resident in the European Union, you also benefit from any mandatory provisions of the law of your country of residence; nothing in this clause deprives you of that protection.
The exclusive place of jurisdiction for any disputes arising out of or in connection with these Terms is, where permitted by law, the competent court at our place of business in Germany. Consumers may also bring claims at the court of their place of residence.
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be resolved by the competent courts as set out above.
The European Commission provides an Online Dispute Resolution platform that can be accessed at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG).
We are not liable for any failure or delay in performance to the extent caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, labour disputes, governmental action, internet or cloud-provider outages, AI-provider outages, telecommunications failures, or pandemics.
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be struck or limited to the minimum extent necessary and the remaining provisions shall be enforced to the fullest extent under law.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dr. Alper Beser regarding the Service and supersede all prior agreements and understandings on this subject.
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation or sale of all or substantially all of our assets, or to a successor in interest.
We may update these Terms from time to time. You are advised to review this page periodically for any changes. For
material changes, we will provide advance notice in-app or by email at least 7 days before the new Terms take
effect. Your continued use of the Service after the new Terms take effect constitutes your acceptance of those
Terms.
